In recent years, there have been frequent cases of overseas buyer fraud, and many export enterprises have suffered hidden losses. Recently, buyers from countries such as Mexico, Pakistan, and Paraguay have been involved in multiple fraud cases. Please pay special attention to export enterprises!

1. Mexico

Related risk prevention suggestions

According to feedback, this group plans to come to China in the near future to meet with the Export Chamber of Commerce. It is recommended that export enterprises carefully identify their counterparties when signing contracts. The specific suggestions are as follows:

1. Preliminary screening based on buyer's commercial information

It is recommended that export enterprises in relevant industries fully understand the buyer's background before signing trade contracts, compare it with the above information, and pay special attention to whether the actual controlling shareholder of the buyer overlaps with the above buyer information. Trade conducted through intermediaries should pay attention to the actual recipient information and avoid transactions with the aforementioned buyers.

2. Actively retrieving credit reports to avoid risks

It is recommended that export enterprises apply to China Export&Credit Insurance Corporation for the latest buyer credit report before engaging in trade with buyers in the Mexican textile industry. Especially for small and micro enterprises with weak risk prevention capabilities, it is recommended to promptly obtain buyer information to avoid trade fraud.

2. Paraguay

Since 2014, due to the macroeconomic downturn in Paraguay and its neighboring Brazil, Paraguayan enterprises have been severely affected by the decline in product prices. Especially when agricultural companies purchase fertilizers and agricultural chemicals, the market price upon receiving the goods can even decrease by 50% compared to the purchase price. In this context, Paraguayan buyers often experience delays or inability to make payments.

Due to Paraguay's strict regulations on importing chemicals, companies in Paraguay need to obtain government licenses and register. Therefore, some small companies without licenses will use the licenses of large companies, while large companies will hire some small companies to trade when the quota is insufficient. Both companies need to take the necessary measures.

On the other hand, Brazil has stricter regulations on imported chemicals, and registering new companies and changing registration information in Paraguay is relatively easy. Therefore, many Brazilians choose to register companies in Paraguay, especially the city of Ciudad del Este, which is located just near the border of the three countries, making it convenient for raw materials to be processed and exported to neighboring countries.

In addition, the business environment in Paraguay is very harsh, and it is not uncommon for buyers to bribe judges to declare bankruptcy in order to evade payment responsibilities. Based on past recovery experience through overseas channels, some companies may delay payment due to various reasons, even if payment plans have been agreed upon and notarized during the recovery process.

It is recommended that export enterprises not relax their vigilance in transactions, strengthen their sensitivity to details, and pay attention to risk assessment and screening.

3. Pakistan

Recently, some friends who are engaged in foreign trade have reported that they encountered Pakistani trade fraud three years ago, and now the fraudsters are still active and constantly changing companies to cheat. Please pay attention!

This customer is constantly changing their company name and may also switch to a new industry, making it difficult to identify, so everyone may face the risk of being deceived; So when working with Pakistani clients, do not do DP or receive at least 50% of the payment to avoid being scammed.

4. Russia

According to a report on foreign trade in clothing, the Russian clothing brand INCITY maliciously defaulted on payment! The company used contract fraud as a means of concealment, which deceived many clothing foreign trade companies.

The company's approach is to use the same brand in China to engage in procurement contract fraud with three different companies (MK, FC, etc.). The same group of people doing business with you under different company names. The specific techniques are as follows: during multiple cooperation processes, this time we will evaluate the production contract in the name of a European company for you, and next time we will find a reason to sign the contract in the name of a Hong Kong company for you, but the products we produce are all of the same brand as INCITY.

Many suppliers feel that it is also reasonable to sign production contracts and receive a deposit for production. In this cooperation process, the amount owed is increased through snowballing. Suddenly one day, I won't give you an order. You are holding the contract to recover the payment, and INCITY Company in Guangzhou will tell you that this has nothing to do with them. INCITY companies in Hong Kong and Europe have gone bankrupt, and they don't owe you the payment. Actually, the same group of people are engaged in contract fraud.

INCITY Guangzhou has been in arrears with suppliers for up to six months, and has not fulfilled payment obligations until dissolution. Prior to dissolution, the supplier has not been notified, indicating malicious subjective behavior.

Related risk prevention suggestions

1. If the situation is unclear, do not sign the contract

Before signing the contract, it is necessary to thoroughly understand the other party's qualifications, corporate reputation, registered capital, affiliation, business status, equipment conditions, technical status, and contractual capacity through the industry and commerce department, bank, or authorized lawyer. It is also necessary to carefully verify the relevant documents and materials provided by the other party to prevent the other party from using fake units, identities, documents, or sources of goods to engage in fraud.

2. Carefully review the contract terms

When signing a contract, it is necessary to strictly abide by national laws and policies, and not to evade the law for the sake of small profits. The terms of the contract, as well as every word, sentence, and punctuation point, should be carefully studied and repeated to ensure that the contract provisions are complete, accurate, and not ambiguous. The name, measurement standards, quality standards, etc. of the subject matter of the contract must be clearly defined and comply with relevant national regulations. If necessary, samples must also be sealed. The time, place, method, and breach of contract liability, as well as the method and location for resolving disputes, must be clearly and unambiguously agreed upon. It is necessary to prevent the occurrence of ambiguous language and clauses that can cause ambiguity and other interpretations. It is best to have a lawyer review and notarization when signing the contract.

3. Set guarantees, just in case

When signing contracts for loans, sales, transportation of goods, and processing, the creditor may, in accordance with the provisions of the Guarantee Law of the People's Republic of China, establish guarantees through guarantees, mortgages, pledges, liens, deposits, and other means. If the contract cannot be fulfilled, the creditor may obtain compensation through various guarantee methods.

4. Report the case in a timely manner to reduce losses

When discovering the possibility of being deceived, it is necessary to report the case to the public security organs in a timely manner. If you are unsure whether it is a contract fraud or an economic dispute, you can also directly file a lawsuit with the people's court and apply for property preservation. If the people's court believes that it is a fraud crime during the trial, it will be transferred to the public security organs as a criminal case for processing. This can minimize losses.
